The Rental Agreement is an agreement between the prospective hirer and the Company to rent the vehicle including all accessories, tools, tyres and equipment and any replacement vehicle (the vehicle).

Payment Method

An initial, non-refundable deposit will be secured at the time of booking confirmation. Accepted credit cards are Visa and MasterCard.

All payments need to be made in advance before the vehicle is picked up along with bond required according to the vehicle.

For all deliveries, airport and after hours pickups

Advance Car Rental will contact you as balance due will be secured prior (48 hours) to your arrival to pick up your vehicle. Please arrange to have the funds available on your nominated account a few days prior to pick up. Accepted credit cards include Visa, MasterCard which incur a 1.95% fee (along with Amex and Diners Club which attract an additional 5.5% per transaction.)

Bond

Credit Card Bonds: You MUST provide a credit card bond to Advance Car Rental. This will be authorized at the start of rental for an amount of $200.00 (may vary for Toyota Camry, SUV, commercial, station wagon, people movers and premium vehicles). A credit card authorization holds or secures an amount on your credit card, allowing Advance Car Rental access to the funds in the event additional amounts need to be charged, (such as damage liability, rental extension or fuel charges). In some cases, the bond payment may be charged, instead of an authorization.

A credit card authorization is not a charge but it will limit the funds available on your credit card (may differ for debit and some international cards). Please note that Advance Car Rental is unable to cancel a pre-authorization once it has been processed. The pre-authorization is automatically cancelled by the customer’s credit card provider between 4– 15 working days if the pre-authorization is not used by Advance Car Rental. Please note that the credit card used has to be in the same name as the main driver picking up the rental car unless a credit card holder provides a credit card authority form along with a photo id authorizing the use of the credit card.

Note: MC/Visa Debit cards are considered a credit card, and the same rules apply as above except bond price will increase according to the vehicle. However, for premium vehicles, debit cards will not be accepted for bond/security/authorization.

AMENDMENT

An amendment fee of $22.00 may apply on top of the rate difference according to the time period selected and will be charged should you decide to make changes against your confirmed booking.

CANCELLATION TERMS

Note: The initial deposit is non-refundable. Along with the deposit the following charges will apply:

If cancelled within 10 days of pick-up: $35.00 fee

If cancelled on the day of pick-up or non-appearance: No refund on total cost of rental.

There is no refund for late pick up or early return of vehicle.

LIMITED KILOMETRES

Advance Car Rentals by offering limited kilometres and can offer cheaper and competitive pricing for its customers

Please note that 200kms per day only are included in the base rental price of your booking for most of the standard vehicles unless specified differently on the reservation. Additional kilometres will be charged as below:

Holden Commodore – 22c per additional kilometre

Holden Captiva- 22c per additional kilometre

Toyota Commuter – 22c per additional kilometre

Toyota HI Ace – 33c per additional kilometre

Toyota Tarago – 33c per additional kilometre

Hyundai Getz – 22c per additional kilometre

Toyota Corolla – 22c per additional kilometre

Toyota Camry and Toyota Camry hybrid – 22c per additional kilometre

For all Premium vehicles (Chrysler 300c, Toyota Kluger,and Mitsubishi Pajero)  – 44c per additional kilometre

PLEASE NOTE some vehicles will have an option for unlimited kilometres under extras

VEHICLE CONDITION AND RETURN

The vehicle is delivered to the hirer in good operating condition with the seal of the odometer unbroken. The hirer agrees to return the vehicle in the same condition (except for ordinary wear and tear NOT INCLUDING WINDSCREEN OR TYRE DAMAGE) together with all tools, tyres, accessories and equipment to the location and on the date specified (or sooner, if demanded by the Company) on the Rental Agreement. The Company may take possession of the vehicle without prior demand and at the hirers expense, if it is illegally parked, used in violation of the law or of the agreement or if it is apparently abandoned. If the seal of the odometer is broken the person responsible will be reported to the appropriate authority and the hirer is responsible for extra charges based on 500 kilometres per day at 50c per kilometre.

Note: The company must be notified and agree to any extension of the period of hire beyond that stated on the agreement in advance of the return date and time or the vehicle will be immediately reported as stolen.

UNAUTHORISED AND PROHIBITED USE

Persons who must not drive the vehicle

a) A person who is not identified on the agreement or has not been identified in writing to the company or approved by the company in writing.

b) A person who is not licensed for that class of vehicle.

c) A person whose blood alcohol concentration exceeds the lawful percentage.

d) A person who has given or for whom the hirer has given a false name, age, address or drivers license details.

e) A person holding a provisional license or whose drivers license has been cancelled, endorsed or suspended within the last three years. Overseas licenses must be in English or alternatively an International Driver permit or acceptable translation may be carried.

f) A person who has held a drivers license for less than two years.

Circumstances in which and/or for which the vehicle must not be used:

g) Outside the area of use limitations shown on the agreement.

h) On unsealed roads or off road conditions unless authorised by the company in writing or the face of the agreement.

i) To carry persons for hire or to carry any inflammable, explosive or corrosive materials.

j) To propel or tow any vehicle, trailer, boat or other object unless the company has authorised such use in writing.

k) To carry any greater load and/or more persons than is lawful or use in a manner or for a purpose other than for which it was designed and constructed.

l) For racing, pacemaking, reliability trials, speed trials, hill climbing or being tested in preparation for those purposes.

m) In a dangerous manner.

n) In contravention of any legislation or regulation controlling vehicular traffic or for any illegal purpose.

o) Unless specified at the time of booking, interstate travel is prohibited.

Note: If the Company received intimation regarding the vehicle being used to travel interstate without prior approval, the hirer will be charged a fee of $45 per day. Further, the vehicle will no longer be covered under any company policy.

TRAVELLING ABOVE THE SNOW LINE

If you are travelling to the snow fields or above the snow line you must purchase the Snow Pass. The snow line is defined as the gates leading to any of the national parks or snowfields in Australia between 1 June and 31 October, or any area where it is indicated or required that show chains are to be fitted to the vehicle. Snow Pass allows you to drive on sealed roads and within sealed car parks above the snowline. Without the Snow Pass, the vehicle is uninsured above the snow line. Please ensure snow chains are either fitted or carried depending upon your vehicle. Regular car rental terms and conditions void all insurance cover if a vehicle is taken above the snowline without the snow pass or required fittings. Snow Pass does not reduce the excess payable. Customers can reduce their excess by taking Snow Pass in conjunction with our Smart Cover or Ultimate Cover.

FINANCIAL OBLIGATIONS

Special Note: Joint hirers and all drivers are jointly responsible under the agreement.

The hirer is responsible at all times and will pay the company by allowing and authorising the company to debit their credit card/deposit for the balance of the following charges:

a) All rental charges specified on the agreement.

b) All charges claimed from the company in respect of parking or any other traffic violations incurred during the period of hire or until such later time as the vehicle is returned to the company.

c) All loss or damage to the motor vehicle (including loss of use), third party damages, legal expenses, assessment fees, towing and recovery, storage and company service charges where

(i) any condition of the agreement or any special condition on the agreement has been breached.
(ii) the vehicle is involved in a single vehicle accident unless the Company waives such loss to a single vehicle liability amount shown on the agreement.
(iii) the hirer has left the vehicle unlocked or left the keys in the vehicle and/or has not kept the key secure.
(iv) the under body of the vehicle is damaged regardless of cause when no other vehicle is involved.
(v) the vehicle is totally or partially immersed in water regardless of cause.
(vi) the interior of the vehicle is damaged regardless of cause when no other vehicle is involved.
(vii) the tyres of the vehicle are damaged other than by normal wear.
(viii) the vehicle is damaged by driving it under or into an object lower than the height of the vehicle.
(ix) the hirer has failed to maintain all fluid and fuel levels or failed to immediately rectify or report, to the company any defect of which the hirer becomes aware
(x) the vehicle is damaged by loading or unloading, other than normal wear
(xi) the hirer fails to secure properly any load or equipment which leads to loss caused by any part of said load or equipment

Special note:
1. If the hirer has paid by use of a credit card or directed the company to bill charges to some other person, corporation, firm or organisation who or which fails to make payment when due, the hirer will immediately pay the full amount due to the company on demand.

2. If the Company does not receive the amount due for its services within 30 days from the due date, the Company has the right to forward the outstanding account to a debt collection agency. Also, in such cases the Company will charge a lodgement fee equivalent to the commission charged by the debt collection agency.

If the hirer acts within the terms and conditions of this agreement the company may grant damage cover (including legal costs incurred with the company’s consent) for hirers benefit in respect of damages to the vehicle or third party damage other than any property owned by the hirer (or any friend, relative, associate or passenger) or in the hirers physical or legal control. This cover is subject to:

a) hirers payment of the damage/loss liability charge stated on the agreement.

b) hirer not having acted or having caused any other person to have acted in any manner which is in contravention of the agreement including the special conditions .

c) hirer not being covered under any policy of insurance.

d) hirer providing such information and assistance as may be requested and, if necessary, authorising the company insurer to bring, defend or settle legal proceedings, but the company shall have sole conduct of the proceedings.

GENERAL PROVISIONS

a) Hirer will promptly report any incident involving loss or damage to the vehicle or loss involving the vehicle while rented under the agreement to the company location where the vehicle was hired and will deliver to the company immediately, every summons, complaint or paper in relation to such loss.

Compliance with this sub-paragraph does not excuse the hirer from reporting all incidents to police or other proper authorities.

b) Hirer releases and holds harmless the company (and its agents and employees) from all claims for loss or damages to their personal property, or that of any other person left in the vehicle, which is received handled or stored by the company at any time before, during or after this rental period, whether due to the company’s negligence or otherwise.

c) Except as provided by law no driver or passengers in the vehicle shall be or deemed to be the agent, servant or employee in any manner for any purpose whatsoever.

d) The company gives no express or implied warranty as to any matter whatsoever including without limitation the condition of the vehicle and equipment, its merchantability or fitness for any particular purpose.

e) No right of the company under this agreement may be waived except in writing by an officer of the company.

f) Words used in the agreement to denote any gender shall include all genders, singular words include the plural, and noted on the agreement.

Note: Outside the normal opening hours, depositing the keys and documents in a letter box does not mean the end of rental. You remain liable for any damages until an employee from Advance Car Rental takes the possession of the vehicle, documents and keys.

FUEL

The vehicle must be returned with the amount of fuel equal to that at the time of the rental. If the vehicle is returned with less fuel the difference will be charged at a rate which may include a service component unless prior arrangements have been made and noted on the Rental Agreement.

TOLL USAGE

To pay for toll usage, Advance Car Rental recommends that the hirer should purchase a Melbourne pass. A Melbourne pass covers you for travel on CityLink and EastLink (tollways with no cash booths). You can buy a Melbourne pass up to midnight on the second day after your nominated day of travel from https://www.citylink.com.au  or 13 26 29 only. A once-off account opening fee will set up your Melbourne Pass and have it linked to your nominated credit card. Your credit card will be automatically debited with the tolls plus vehicle matching fee for each trip from the applicable toll road. A Melbourne Pass is valid for up to 30 days, from the time of your first trip on CityLink or EastLink, on your nominated Day; this time frame can also be extended.

GPS UNIT
Reliability of the direction is subject software provided by the supplier. The renter agrees to release and hold Advance Car Rental harmless for any GPS unit failure.

ROADSIDE ASSISTANCE
All charges will be passed on to the customer in addition to an administration fee of $44 which will be applicable, unless the call out is due to a manufacturing fault.

EARLY RETURNS
There will be no refunds given for the early return of rental vehicles.

LATE RETURN CHARGE
If vehicle is not returned on time allocated or unless notified, a grace period of 29 minutes will be granted. Extra hours will be charged as follows.
0-29 minutes – no charge.
30 minutes – 59 minutes: 1/2 the daily rate
over 1 hour – 1 full day is charged

PRICING
Vehicle rental rates change very frequently. A rental quote may be received via many channels including but not limited to direct telephone lines and company website. Unless specified, a rate quote you receive is merely indicative of the rates then being offered and creates neither legal rights nor practical expectations of vehicle availability or the continued applicability of the quoted rate.

Rates quoted on the web site are based on Cash Payment in Advance, Limited supply available and KM restrictions apply.

Rates quoted on web site are exclusive of Goods and services Tax,Vehicle Registration Recovery Fee, Contract Processing fee,Collision Damage Waiver and any premium location surcharge if applicable.

Note: Web specials, deals, offers, and discounted rates are not applicable during and around school and public holidays.
